Applying for a Benton County Marriage License

Benton County has an online marriage license pre-application that lets you enter your information before your visit to the courthouse. Go to the Benton County online marriage form to complete the online pre-application. Entering your information online ahead of time makes your visit to the courthouse much shorter. You still need to come in person with your future spouse, but the paperwork will be mostly done.

Both parties must be present to receive the marriage license. You each must bring a government-issued photo ID. You must both be over 18 years old. The clerk's office requires this in every case. Under Indiana Code 31-11, no marriage license may be issued unless both applicants appear and meet the legal requirements. Benton County follows these rules exactly. At least one applicant must be a Benton County resident. Out-of-state couples who plan to marry in Indiana must apply in the county where the ceremony will take place.

You can also use the state's online marriage application at in.gov/courts/services/marriage-license to prepare before your visit. This is an alternative to the Benton County-specific form and covers the same basic information.
